Legislative Roundup: This Week’s “What The Fuckery”

Legislative Roundup: This Week’s “What The Fuckery”

Some days it feels like we’re running a satire site here. I sit down to re-cap the Worst of the Worst and don’t know if I should start with the craziest (Lola Sheldon Galloway) or the stupidest (Daniel Emrich). So instead I’ll start with the most self-serving.

MOST SELF-SERVING

Lola and Steven Galloway are millionaire landlords, and they’re shaping new laws to make themselves even richer. This week, Steven introduced legislation (HB 439) that would make it easier for landlords to evict tenants, and invade their privacy. Read about Steven’s obliquely self-serving bill here: https://wtf406.com/2023/01/galloway-attacks-renters-rights/

Now Steven’s receiving help from his friend to further diminish renter’s rights. Senator Steve Fitzpatrick introduced SB 105, a bill that would “prohibit rent control on private properties.” That means landlords like the Galloways can charge insanely high rental prices. Without rent control Montana’s housing crisis will worsen. Folks will either become unhoused, or they’ll be forced to move out of state. We’re already seeing a huge increase of families living in RVs on the side of the road in Bozeman. Bills like these will worsen the housing crisis. Fitzpatrick’s bill benefits the wealthy (ie all the elected Reps in Great Falls) at the expense of the rest of us.

MOST HEARTLESS

Most Heartless is actually a tie this week.

The “Pro-Life” Party was hard at work killing kids again. Steve Gist, Scott Kerns, Steven Galloway, and Lola Galloway all voted against funding for youth suicide prevention. Montana continually leads the nation in suicides. Youth are particularly at risk, and other bills being heard will likely increase the number of suicide attempts by kids in our state. Denying funding for suicide prevention efforts while simultaneously passing bills that will increase youth suidice? That’s some villain shit right there.
Read about why SB99 is going to kill kids here: https://wtf406.com/2023/01/sb-99-likely-to-increase-youth-suicide/

Senator Daniel Emrich managed to be disgusting on another end of the spectrum. Montana is a Right to Die state, meaning Montana’s can choose to die with dignity assisted by compassionate medical care. Emrich just can’t pass up an opportunity to impose his will on our private medical decisions. The GOP is trying to take away our right to die and criminalize doctors who provide this care. Despite his embarrassing lack of scientific understanding (more to come on this) Emrich decided he knows better than the Montana Hospital Association, doctors, patients, and their families.  Emrich’s unkind and uninformed comments are featured in this article:
https://dailymontanan.com/2023/02/01/bill-would-outlaw-physician-assisted-death-reversing-montanas-current-practice/?fbclid=IwAR3n5NCzUtcONW2Rv_HvqxSmS0POW-CoKWHY8XaDwKlzMA46gs2-3lQRe44

MOST UNEDUCATED

Which brings us to why Senator Emrich should probably sit down when anything even science-adjacent is discussed.  Emrich is trying to ban the teaching of “scientific theory.” No, seriously. The theory of gravity must have hit this breadstick in the head because he clearly lacks even a third-grade level of scientific understanding. Read this somehow-not-a-joke bill here: https://leg.mt.gov/bills/2023/billpdf/LC2215.pdf

MOST ORWELLIAN

Lola Galloway is all over the list this week! Galloway has introduced a bill that would require ALL cell phones in Montana be installed with an ”obscenity” filter. Notably, she provides no definition for “obscenity.” Make no mistake, this is a government surveillance bill. Lola employs a familiar GOP tactic here and is trying to disguise her censorship attempts as an effort to protect children. Her bill asserts that the filter is necessary so kids can’t access obscene materials. Protecting kids from the dark corners of the internet would indeed be a worthy cause- but installing surveillance software on every phone in the state is an insane way to go about it. Further, it’s the responsibility of PARENTS to monitor their child’s internet usage. It sure as hell shouldn’t come in the form of an opt-out piece of government surveillance on every cell phone in the state. Much like the other bullshit “obscenity” legislation we’ve seen this session, the real goal is BIG GOVERNMENT eyes on us and attempts to limit access to material  far-right nationalist Christians don’t like. That’s going to be anything LGBTQ+  and anything non-theistic. If Lola actually gave a fuck about kids, she probably would have voted for the suicide-prevention funding mentioned above.  Read the bill here: https://legiscan.com/MT/text/HB349/id/2668315

GET INVOLVED

Galloway Attacks Renters Rights

Galloway Attacks Renters Rights

When he’s not working diligently to keep his rental tenants in poverty with his hand out at their doors, he’s working in the House to make sure they can join the growing unhoused community in Great Falls. That’s right, Great Falls’ reigning Dairy King and local landlord, Rep. Steven “Mr. LOLA” Galloway, is heading legislation (HB-282) to speed up the eviction process for renters in Montana.

Specifics noted in the bill include:

  1. Protections for landlords to issue 24 hour notices for property access or to correct rental agreement violations with tenants facing eviction proceedings within 3 days for refusing property access.
  2. Putting extra stress on our already overloaded courts by significantly shortening the filing due dates and hearing scheduling windows. Meaning, where courts and tenants typically had a cushion of anywhere from 10-20 days before, multiple lines of Sections 70-24 and 70-33, MCA have been amended to an allowance of only 5 days instead.

Interestingly, or maybe better put – strategically, in reference to the 24 hour notices, there are no exceptions for tenants who may be working out of town, be hospitalized, on vacation, or otherwise. In sum, tenants who are working hard, severely ill, or enjoying time off away from home can find themselves in the crosshairs of their landlord’s impatience.

Rep Galloway was quoted by Montana Public Radio as saying this legislation is an attempt at “alleviating the stress on the judicial system that has more pressing issues”, but if that’s truly the case, why shorten their working time? With Rep. Galloway himself identifying that our courts have more pressing issues, these amendments read as a greasy attempt at further overwhelming the courts and floating their eviction actions with little to no pushback.

While some supporters of the bill say this proposed legislation will be used for “worst case scenarios”, anyone with any kind of sense can see that this is the first of many blows to deliberately weaken already feeble tenant’s rights, and Rep. Steven Galloway is more than happy to be the champion of those endeavors.

Jeremy Trebas The Self-Dealing Senator

Jeremy Trebas The Self-Dealing Senator

Our regular readers are already familiar with the building Jeremy Trebas bought at 1300 1st Ave. N.  The building is currently classified as a church by the Department of Revenue which makes it exempt from most property taxes.  As we pointed out in our earlier article, it is owned by a shell company Trebas created which clearly does not qualify as a church for property tax exemptions, despite the fact that Trebas is currently renting the space to a church group.  (https://wtf406.com/2023/01/the-curious-case-of-jeremy-trebas-property-taxes/)

Let’s start with the building

There is now more to this story– much more.  So, let’s start with the building itself. In 1927 the local congregation of  First Church of Christ Scientists announced its intention to build a church at 1300 1st Avenue N. with an auditorium for 450 people for an estimated cost of $40,000!  Two and a half years later, the “renaissance” style building was completed and began holding services with a large pipe organ, reading rooms, and Sunday school classrooms. (Looks more like Art Deco style to us, but we’ll go with the Great Falls Tribune.)

Fast forward to almost a century later. The building was sold to Karpeles Manuscript Library Museums.  This national organization was founded in 1983 by California real estate magnates David and Marsha Karpeles.  David Karpeles’ passion was collecting old manuscripts.  With the goal of stimulating interest in learning, especially in children, and to make the collection more accessible, they began acquiring historic buildings and distributing historic documents to those local  museums. There are currently 12 such local museums in small to mid-sized cities across the country.

The Karpeles organization was clearly moving forward with plans to open the museum in Great Falls, including hiring local staff and having the museum name added in raised lettering to the stucco finish. But, they abandoned the project and put the building on the market.  There were probably numerous reasons for the decision not to proceed with the Great Falls museum.  These include the fact that the benefactor, David Karpeles died in January of 2022, the disruption of the pandemic, and potential costs of bringing the historic building ”up to code.”  In May of 2022, Jeremy Trebas purchased the building.  That’s where this story gets interesting.

But first a bit about building codes

Building codes are about making sure  that buildings are safe, accessible and meet community standards and needs.  It is common that historic buildings fall behind the various changes in building codes.  Owners of these buildings are often not required to update the building, because they have been “grandfathered in.”  But, when a building like this changes its purpose, it is common that the new owners are required to bring the building into compliance with the current code.

In this instance, when the Karpeles group purchased the building, it was aware that it would no longer be classified as a religious institution and repairs were going to be required.  Specifically, there were some handicapped access issues and importantly the code required an automatic sprinkler system.  Automatic sprinkler systems are expensive, because they require a separate line to the water main and monitoring systems to alert occupants if there is a loss of pressure or other malfunction in the water lines.

So, to summarize, the building was put on the market with any prospective buyer understanding the need for costly repairs to meet code requirements, particularly fire safety.  The need for costly repairs lowers the value of the building.  Enter Senator Jeremy Trebas.

Senate Bill 195 introduced by Jeremy Trebas.

Why would anyone buy a large commercial building with high property taxes because of its size and which needs significant investment to bring it up to code?  Well, we already pointed out that the property tax classification of the building has not changed from a church so, thus far, Trebas has not paid much in property tax.  Moreover, he rented to a church which could very well be a lame attempt to hang onto subsidized property taxes or, as we have said, it could be that Trebas has simply not gotten around to notifying the Department of Revenue of the change in building use.

But then Trebas introduced Senate Bill 195.  This bill exempts his building, and others like it, from the requirement for automatic sprinkler systems.  It  defines exempt properties as an existing structure that is not over 12,000 total square feet, has an occupancy that is limited to less than 300, and has fewer than three stories above grade.  In addition, a community group working on homeless issues in Billings proposed an amendment to help homeless people which has been attached to Trebas’ bill.  Despite being opposed by firefighters and fire marshals, the bill has passed out of committee in the Senate.

Bottom line, Trebas is using his seat in the Senate to enrich himself.  This whole episode speaks volumes about Trebas’ ethics in government and in business.  We wonder if he has thought at all about the previous owners who obviously had to accept a lower price because of needed repairs.  Or has he thought of the other parties who were interested in buying the building but didn’t have the title Senator in their hip pocket.  Probably not.  It seems Jeremy Trebas is only concerned with Jeremy Trebas.

SB 99 Likely to Increase Youth Suicide

SB 99 Likely to Increase Youth Suicide

Montana’s suicide crisis continues to make national news. Easy access to firearms and a paucity of rural healthcare availability no doubt contribute to Montana consistently landing among the top states for suicides per capita. Now, Montana Republicans are targeting our most vulnerable- Queer kids.

Suicide is already the second leading cause of death for kids in the United States, and LGBTQ+ kids are four times more likely to attempt suicide than their straight peers.

Interestingly, Montana’s own DPPHS report addresses the increased risk of suicide among LGBTQ+ kids. The report also notes, “Each episode of LGBTQ victimization, such as physical or verbal harassment or abuse, increases the likelihood of self-harming behavior by 2.5 times on average.” Read the DPPHS report here: https://dphhs.mt.gov/assets/suicideprevention/SuicideinMontana.pdf

Preventing youth suicide would seem like a given. But let’s not pretend the MT GOP supermajority has any shred of decency. Rather than provide resources and funding to bring these tragic numbers down, Republicans instead are attempting to withhold healthcare for Queer Montanans. (Yes, we believe even those Montanans under 18 still count as whole, self-determining humans worthy of representation in our government.)

Enter the “Slate of Hate” as it has been branded by multiple non-profit agencies and human rights activists. The Montana Human Rights Network has identified a whopping 54 bills in the 2023 session with clear anti-lgbtq goals. Unsurprisingly, a number of those bills are sponsored by Great Falls’ own embarrassments, including “I Don’t Have to Pay Fair Property Taxes’ Jeremy Trebas and the world’s worst landlord, Lola Sheldon Galloway. More about these bills will be shared below.

Most urgent is SB 99, proposed by another Flathead-area bigot, Senator John Fuller. Fuller’s bill seeks to deny gender affirming care to minors. SB 99 would totally eliminate the rights of children and their parents to make appropriate medical decisions in consultation with qualified medical professionals. If this bullshit bill sounds familiar, it’s because we’ve literally heard it all before. Fuller introduced an incredibly similar bill during the 2021 session, which ultimately died on the Senate floor. But its a new session, and Senator Fuller still has a burning desire to watch Queer kids die. Denying them healthcare is one of the best ways to do that.

Montana’s own Health and Human Services agency recognizes the acute risk of being an lgbtq+ teen.  Further, data also shows that gender affirming care SAVES lives. Yes, the very care Fuller wants to eliminate is what helps many kids survive into adulthood. Here’s a quick recap of a study showing the importance of gender-affirming care: https://www.columbiapsychiatry.org/news/gender-affirming-care-saves-lives

Perhaps Fuller and his ilk aren’t aware of this data. More likely, they hate Queer people enough that they would simply prefer us dead. If verbal harassment doubles the rate of lgbtq+ youth self-harm, what effect are these GOP bills having on our kids? If this bill passes, our answer will be found in the local Obituaries.

Take Action To Stop SB 99

The good news is that the 2023 session has shown us the power of pushing back. We saw Keith Reiger immediately walk back his attempt to dismantle reservations after the idea was met with tremendous national backlash. Like most bullies, Republicans back down quickly when someone stands up and says “No more.”

Enter you, dear reader. You have an opportunity to stop Fuller’s bill, and the entire Slate of Hate, all from the comfort of your home. The bill is being heard this Friday, January 27, 2023. Follow this link to submit written testimony to OPPOSE SB 99 in the SENATE JUDICIARY COMMITTEE. https://leg.mt.gov/public-testimony/

Lola Takes “Fringe” To New Levels

Lola Takes “Fringe” To New Levels

There I was.

Having a great morning, sipping on some tea from my favorite local coffee shop. Knowing in the peripheries of my mind that somewhere, somehow, a Cascade County Representative was making a mockery of themselves and our city. But alas, I was blissfully unaware of exactly what was occurring.

And then it happened.

A friend sent a photo of Great Falls’ very own, LOLA (aggressive capitalization intended) Sheldon-Galloway sporting a vomit-inducing, repugnant fringe number while attending today’s House Judiciary Committee meeting which included a hearing on HB 163 – a missing and murdered Indigenous women task force bill.

I’d say that seeing the photo was like watching a car crash, but it’s more like watching those cyst removal videos on Tik Tok. Like, “Damn, I don’t want to see this but apparently the universe wanted to present this to me.” You don’t *really* want to witness it, but it’s now been put in front of your face, and even though your stomach kind of hurts and you want to look away… you can’t.

Since “Discovery” [insert a massive eye roll here], Indigenous people, particularly women, have been stolen from their homes and forced to perform sexual acts with, carry out manual labor for, and bear children to colonizers. A major contributing factor to this? The sexualization, fetishization, and dehumanization of Indigenous people. When colonizers, and particularly those holding political office, have woven legal policies and heighten rotten social customs to distance themselves from Indigenous people we get: LOLA, in fringe.

Truly, it doesn’t take the late Joan Rivers to point out what an atrocity the caped leather vest is, especially paired with what appeared to be double braids in her hair. But we’re not here to pretend play ‘Fashion Police’, as fun as that may be. What we are here for is to call out our local representation to leave sexualized imagery of Indigenous people in the past, not present it on a statewide platform in Committee meetings.

While we’d love to believe that LOLA has turned a page and today’s get up is how she’s showing her support and solidarity for the MMIW/MMIP crisis (however misguided), her documented history of voting against protecting and uplifting Indigenous people makes it hard to give her the benefit of the doubt.

Some specific instances from back in 2019 include: a no vote to HB 33 – a bill to extend a Montana Indian Language Preservation program, voting no to HB 42 – a bill to extend the Cultural Integrity and Commitment Act, and yet another no to HB 135 – a bill to create a tribal college credit transfer and student opportunity task force.

Knowingly using the likeness and sterotypical, wild west fantasy-esque imagery of Indigenous people while simultaneously and continuously proposing legislation that will no doubt harm that same population is right on track for LOLA.

Today’s showing is a good reminder that LOLA is in fact simply one of many wolves in sheep’s clothing (or colonizers clothing) ‘representing’ Great Falls.

Breaking News!  Great Falls Representative, Steven Galloway, Joins the Circus

Breaking News!  Great Falls Representative, Steven Galloway, Joins the Circus

In a press release straight out of the Capitol City, the three ring circus known as the Montana Freedom Caucus announced that Great Falls representative, Steven Galloway, has joined their fourteen member cast of clowns.  In the press release issued by the circus, Clown Queen Theresa Manzella, Republican Senator from the Bitterroot Valley, regurgitated the punchlines of many on the far right,  “We stand for states’ rights and work to rein in federal overreach. Montana citizens have made it clear that this is their desire.”  So much for originality.

Our readers may remember when Manzella brought her roadshow to Great Falls at the invitation of the local Pachyderm Club.  Her act that time around was joining the jokers on the far right poking fun at local elections by trying to fool people into thinking that elections in Montana are corrupt.  (Check out  our story  https://wtf406.com/2022/09/the-big-lie-in-cascade-county/ )

The Montana Freedom Caucus is a wholly owned subsidiary of the national circus franchise, the Congressional Freedom Caucus in Washington DC.  Montana Representative Matt Rosendale is an active clown in the national group, having developed a character who dresses like a Montana cowboy, but speaks with a thick Maryland accent.  Most recently the national group dominated the media by catching Representative Kevin McCarthy, demanding he obey them and repeatedly hitting him with pies in the face until he agreed to their demands.  As part of their routine, Rosendale took to the House floor and delivered an unintelligible speech criticizing . . .well it was hard to tell what he was criticizing. The media covered his speech with the headline, “Rosendale rages against a non-problem in viral speech, say political analysts”  (https://billingsgazette.com/news/rosendale-rages-against-a-non-problem-in-viral-speech-say-political-analysts/article_4bec7336-8e32-11ed-8b60-67f4e4525fdc.html )

Rosendale is clearly trying to get his pies in order to throw them in the face of Senator Jon Tester in the 2024 election.  But first he’ll have to beat fellow clown Ryan Zinke who has his own routine imitating a Montana cowboy.  In the Montana circus press release, Rosendale said,  “I’m proud to work with veteran and newly-elected lawmakers to ensure every Montanan has a voice in our representative government.”  What he didn’t say, but we all know it’s what he means is, “These are the clowns that are going to help me beat Zinke”

It is not clear what role Steve Galloway will play in this troop of clowns. It is clear he is not likely to emerge as a leader.  His wife Lola, who is also in the legislature, is far more likely to end up in a leadership role. She has already developed a comic character with flashy hats pushing a baby carriage with a doll in it.

Time will tell. The group plans to have a show in Helena in January.  Grab your popcorn and get a seat.  It’s bound to be entertaining!
